In the Third Circuit Court of Appeal, David R. Sobel won the first Louisiana case addressing the res nova issue of whether a medical malpractice claim against a qualified health care provider must still go before a medical review panel in accordance with the Louisiana Medical Malpractice Act when a public health emergency has been declared pursuant to the Louisiana Health Emergency Powers Act. The court held that any claims brought by plaintiffs, other than intentional acts, must first be presented to a medical review panel. Whitehead v. Christus Health C. Louisiana, 344 So. 3d 91 (La.
